Notice of Intent:
A Notice of Intent application provides the Conservation Commission and the DEP with a complete and accurate description of:
- The site, including the type and boundaries of the resource areas under the Wetlands Protection Act and;
- Proposed work, including all measures and designs proposed to meet the performance standards described in the Wetlands Protection Act Regulations, 310 Code of Mass. Regulations (CMR) 10.00 for each applicable resource
Forms are submitted always in duplicate to the Commission (include 2 copies of the proposed plan with a complete and accurate description of the site and project).
Two copies must also be sent to the DEP, 20 Riverside Drive, Lakeville, MA 02347. The owner may retain a Land Surveyor or an Engineer to help
prepare documents. The applicant is also responsible for advertising the public hearing notice.
A hearing must be held 21 days from receipt of application and a decision must be issued 21 days from the date the hearing is closed. A hearing cannot be
closed without a file number from DEP.
Abbreviated Notice of Resource Area Delineation:
Provides a procedure for an applicant to confirm the precise boundaries of a bordering vegetated wetland.
Request for Determination:
A project that is not major or if the applicant is not sure what the project entails. The Commission must issue a decision 21 days from receipt. If the hearing is goes beyond 21 days, the applicant must request a continuation in writing.
Enforcement Order or Cease and Desist Order:
May be issued due to a unanimous phone call or drive-by sighting by a member of the Commission that a violation of the Wetlands Protection Act has taken place.
Order of Conditions:
Is issued upon an approval of Notice of Intent 10 business days or 14 calendar days prior to the closing of the hearing. An Order of Conditions must be recorded at the Registry of Deeds and proof of recording must be supplied to the Conservation Commission. An Order of Conditions is good for a three-year period. If an applicant requests and extension, it must be requested at least 30 days prior to the expiration date of the Order of Conditions.
